- Trademark: Protects brand names, logos, and symbols used to identify the source of products (e.g., the Rodeoestate name and logo).
- Patents: Protects inventions and functional designs.
2. Our Responsibility as a Retailer
As a retailer based in Australia serving international customers, Rodeoestate takes the following steps to protect IP:
- We only source products from reputable suppliers who verify the authenticity of their designs.
- We strictly prohibit the sale of counterfeit goods or unauthorized replicas.
- We proactively monitor our listings to ensure that our descriptions and images do not infringe on the rights of third parties.
3. Procedure for Claiming IP Infringement
If you are an IP owner and believe that your rights have been violated on our site, please submit a formal Notice of Claimed Infringement. This notice must include:
- Full identification of the IP right claimed to have been infringed (e.g., Trademark Registration Number).
- A clear description and location (URL) of the material on our site that you claim is infringing.
- Your complete contact information (Name, Organization, Address, Phone, and Email).
- A statement that you have a "good faith belief" that the use of the material is not authorized by the IP owner.
- A statement, under penalty of perjury, that the information in your notice is accurate.
4. Consequences of Infringement
Upon receipt of a valid IP claim, Rodeoestate will move quickly to remove or disable access to the allegedly infringing material. We also reserve the right to terminate the accounts of repeat infringers and seek legal remedies if our own IP is violated by third parties.
5. Limitation of Liability
While we take every precaution to respect IP rights, Rodeoestate is not liable for inadvertent or technical errors that may lead to a temporary display of disputed material. Our primary goal is immediate resolution through our support channels.
